This wrongful death case arose out of the negligence of the defendant in performing a breast augmentation. Plaintiff's mother, a 31 year old women, sought out Defendant's services. Defendant was negligent in performing the operation and she fell into cardiac arrest. She died in route to the hospital. After 5 days of trial when the defendant had to be made aware of possible criminal charges and of his Fifth Amendment rights, the defense asked for a recess during which they settled for an confidential sum of money.
